Terms of Service & Platform Governance

1. Commercial Capacity & Agreement Acceptance
These Master Terms of Service ("Terms") constitute a legally binding contract between WebFit Technologies Ltd ("WebFit.ai," "Company," "we," "us") and the corporate entity or business user ("Client," "you") accessing our Answer Engine Optimization (AEO) diagnostic platform, API endpoints, or generated executive dossiers.
Commercial Capacity Only: The WebFit.ai platform is engineered exclusively as a B2B diagnostic and intelligence tool. By initializing an account or executing a domain scan, you warrant that you are acting in a professional or commercial capacity on behalf of a registered enterprise entity.
2. Domain Scan Authorization & Crawling Warranties
To generate our 9-Pillar Telemetry Dossiers, WebFit.ai deploys automated diagnostic crawlers to evaluate target domains against our 500-point AEO evaluation framework.
Mandatory Authorization Warranty: By submitting any URL or target domain to the WebFit.ai diagnostic engine, you explicitly represent and warrant that you are an authorized owner, executive, or contracted technical representative possessing full legal authority to grant WebFit.ai permission to crawl, extract, and analyze the target domain's public assets.
You agree to fully indemnify and hold harmless WebFit Technologies Ltd against any claims, losses, or legal demands resulting from unauthorized domain submissions or false representations of domain ownership.
3. Intellectual Property Rights & Dossier Ownership
3.1 Company Proprietary IP
WebFit Technologies Ltd retains all title, trademark, and intellectual property rights in and to the WebFit.ai platform, including its proprietary 500-point diagnostic methodology, crawler architecture, threat score calculation models, interface design, code, and Audit Copilot algorithms.
3.2 Generated Report Deliverables
Upon payment of applicable license fees, WebFit.ai grants the Client a perpetual, non-exclusive, non-transferable license to use, download, present, and distribute internally the generated Board-Level Dossiers, competitive matrix charts, and remediation recommendations compiled specifically for the Client's domain.
4. Third-Party AI Engines & Non-Deterministic Disclaimer
Independent Intelligence Tool: WebFit.ai is an independent diagnostic auditing platform. WebFit.ai is not affiliated with, endorsed by, or partnered with OpenAI, Perplexity AI, Google LLC, Anthropic, or Microsoft Corporation.
Non-Deterministic AI Disclaimer: Large Language Models (LLMs), Retrieval-Augmented Generation (RAG) frameworks, and Answer Engines evaluate web queries non-deterministically. WebFit.ai provides probabilistic visibility scoring, factual density analysis, and technical readiness metrics. WebFit.ai does not guarantee specific organic ranking positions, zero-click answer placements, or citation frequencies within third-party generative search networks.
5. Acceptable Use Policy (AUP)
When utilizing the WebFit.ai platform or API infrastructure, you expressly agree NOT to:
- Attempt to reverse-engineer, decompile, or extract the underlying source code of our diagnostic engine or threat scoring algorithms.
- Utilize automated scripts to execute distributed denial-of-service (DDoS) style scan volumes against our target servers or third-party web domains.
- Resell, sublicense, or white-label diagnostic reports without entering into an explicit Enterprise Partner Agreement.
- Share authenticated corporate login credentials across unauthorized external parties.
6. Subscriptions, Token Limits & Service Modifications
Subscription tiers (e.g., Visible, Optimised, Dominant) grant specific crawl allocations, prompt tracking thresholds, and API token limits as specified in your commercial order form or dashboard account settings.
Service Updates: To adapt to rapidly shifting LLM architectures, WebFit.ai reserves the right to refine diagnostic vectors, add new evaluation checks, or adjust metric weightings without prior notice.
7. Limitation of Liability & Indemnity
To the maximum extent permitted by applicable law, in no event shall WebFit Technologies Ltd, its directors, employees, or partners be liable for any indirect, consequential, incidental, special, or punitive damages—including loss of profits, commercial opportunities, or business reputation—arising out of your use of or inability to access the platform.
Enterprise Liability Cap: WebFit Technologies Ltd’s total aggregate liability for all claims arising under these Terms shall be strictly capped at the total amount of subscription fees paid by the Client to WebFit.ai during the twelve (12) month period immediately preceding the event giving rise to liability.
8. Governing Law & Statutory Jurisdiction
These Terms and any non-contractual obligations or disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
Both parties irrevocably agree that the courts of London, England shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the WebFit.ai platform.
